1.2 We are committed to safeguarding the privacy of our website visitors. In this policy we explain how we will handle your personal data when you use our site.

1.3 It is important that you read this privacy policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your personal data. 2. How we use your “personal data”

2.1 In this Section 2 we have set out:

The notification data may be processed for the purposes of sending you the relevant notifications and/or newsletters.. We will ask for your prior consent to sending these types of communications unless we are relying on the “soft opt-in” exemption. This exemption applies when you already receive services/goods from us and we send you information on similar goods/ services. This is because it is necessary for our legitimate interests (to grow our business and to show-case our services). You can ask us to stop sending you email notifications and/or newsletters at any time by following any opt-out links on any relevant message sent to you or by contacting us at any time.  Where you opt-out of receiving these messages, this will not apply to personal data provided to us for other purposes.

Our website will generate the metadata associated with communications made using the website contact forms. The correspondence data may be processed for the purposes of communicating with you and record-keeping. The legal basis for this processing is our legitimate interests, namely the proper administration of our website and business and communications with users; and/or the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

2.6 We may process any of your personal data identified in this policy where necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

2.7 We may process any of your personal data identified in this policy where necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, or obtaining professional advice. The legal basis for this processing is our legitimate interests, namely the proper protection of our business against risks.

2.8 In addition to the specific purposes for which we may process your personal data set out in this Section 2, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

2.9 We do not actively collect any special categories of personal data via the website (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

2.10 Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services).

 

3. Providing your personal data to others

3.1 We may disclose your personal data to any member of our group of companies this means our subsidiaries, our ultimate holding company and all its subsidiaries insofar as reasonably necessary for the purposes, and on the legal bases, set out in this policy.

3.2 We may disclose your personal data to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise, or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

3.3 We contract with third party service providers and suppliers to deliver certain services to us, and to enable them to perform those services they may have access to or otherwise process your personal data. We only permit them to process your personal data for specified purposes and in accordance with our instructions. Our service providers change from time to time and we will inform you if this is the case by updating this privacy policy. We currently use the following types of service providers: Vizibility Digital, who manage and maintain our website; and a third party provider who provides server management services. 

3.4 In addition to the specific disclosures of personal data set out in this Section 3, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. We may also provide your personal data to third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.  We will provide information about you to any other person who is authorised by you to act on your behalf.

4. International transfers of your personal data

4.1 In this Section 4, we provide information about the circumstances in which your personal data may be transferred to countries outside the United Kingdom. Where we do this, we will ensure that the transfer is to a country covered by a decision of the ICO or is otherwise made in circumstances where we have put appropriate safeguards in place to protect your personal data in accordance with the UK data protection laws.

4.2 We and our other group companies have offices and facilities in the United Kingdom. 

4.3 The hosting facilities for our website are situated in the United Kingdom. 

 

5. Retaining and deleting personal data

5.1 This Section 5 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

5.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

5.3 Your enquiry data and correspondence data will usually be destroyed 6 months after we have dealt with your enquiry/correspondence unless it is required for an ongoing relationship that we may have with you.

5.4 Your notification data is retained for as long as you wish to receive relevant notifications and/or newsletters from us. If you opt-out we may be required to retain some of your data so that we can make sure that we do not contact you.

5.5 Your usage data does not usually identify you and therefore may be retained indefinitely without further notice to you.  

5.6 In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on its necessity for the proper administration of our website and business and/or the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

5.7 Notwithstanding the other provisions of this Section 5, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

5.8 In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

7.15 We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request. 

7.16 We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

9.1 Our website and services are targeted at persons over the age of 16 and we do not knowingly collect data relating to children
